These Terms of Service are an agreement between you and FitGap. They cover your use of the FitGap app and website. By creating an account or using FitGap, you agree to these Terms and to our Privacy Policy.
The short version: FitGap gives you workout suggestions, not medical advice. Check with a doctor before starting any exercise program, and stop if something hurts. Premium is billed through the App Store or Google Play and renews until you cancel.
Not medical advice. FitGap provides general fitness information and automated workout suggestions, not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before starting any exercise program, especially if you have a health condition, are pregnant, or are recovering from injury. Exercise carries inherent risks and you take part at your own risk, so stop and seek help if you feel pain, dizziness, or discomfort. Calorie and heart-rate figures are estimates, not medical measurements.
Who can use FitGap
You must be at least 13 years old (or the minimum age in your country) and able to form a binding contract to use FitGap. If you use it on behalf of an organization, you confirm you’re authorized to accept these Terms for them.
Your account
You can use FitGap as a guest or with an account through our sign-in provider. Keep your login secure and provide accurate information; you’re responsible for activity under your account. You can delete your account at any time from the app.
Subscriptions & billing
FitGap is free to use for up to five completed workouts per week. FitGap Premium removes that limit for $4.99 per month.
Premium is purchased and billed through the Apple App Store or Google Play. Your subscription renews automatically each period unless you cancel at least 24 hours before it ends. Manage or cancel anytime in your App Store or Google Play account settings.
Payments, refunds, and renewals are handled by the app stores under their terms; we don’t process or store your payment details. Prices may change, and we’ll give notice of changes where required.
Acceptable use
Use FitGap only for lawful, personal purposes. Don’t misuse the service, attempt to reverse-engineer or copy it, resell or scrape it, interfere with its operation, or upload content that is unlawful, harmful, or infringes someone else’s rights.
Your content
Any photos, notes, or other content you add stay yours. You grant us a limited license to store and display that content only to operate FitGap for you. You’re responsible for what you add, and anything you share with friends is only visible to people who have accepted your request.
Third-party services
FitGap connects to services you choose, including Google, Apple, and Microsoft calendars, Apple Health and Apple Watch, sign-in, and app-store billing. Your use of those services is governed by their own terms, and we aren’t responsible for them.
Intellectual property
FitGap, including the app, its content, and its branding, is owned by us and protected by law. We grant you a personal, non-transferable, revocable license to use the app. Don’t copy, modify, or distribute it without permission.
Termination
You can stop using FitGap and delete your account at any time. We may suspend or end your access if you breach these Terms or misuse the service. Sections that by their nature should survive termination will continue to apply.
Disclaimers
FitGap is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law. We don’t guarantee the service will be uninterrupted, error-free, or that suggestions will suit your needs.
Limitation of liability
To the fullest extent permitted by law, FitGap will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of, or inability to use, the service. Where liability can’t be excluded, it is limited to the amount you paid us in the 12 months before the claim.
Changes to these Terms
We may update these Terms as the app evolves. We’ll update the date above and, for material changes, let you know in the app. Continuing to use FitGap after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the jurisdiction in which FitGap operates, without regard to conflict-of-law rules. Add your governing law and venue here before publishing.
